This Pathway Licence document template is a licence from a landowner (called the licensor) permitting a licensee to use a route over its land. The user of the route (called the licensee) has the permission of the landowner to use the land in a particular way but does not have an interest in the land.

A licence is in essence permission for someone to do something on someone else’s property, it is a personal contractual arrangement between the named parties and as such it does not bind the personal representatives, the successors in title and assigns.  A licence differs from a lease and an easement in that it does not create an interest in the land whereas a lease and an easement do create an interest in land.  A licence just allows the licensor to grant the use of a route across its property without granting an easement or a lease.

This Pathway Licence Agreement makes it clear that use of the route by the licensee is by written permission, so that it is not "as of right", and can be used whether or not the licensee owns the property benefiting from the use of the route. It is fully comprehensive and contains options for the payment of a licence fee.
