An Affidavit is a formal sworn written statement of fact, signed by the deponent (also called affiant) in front of a commissioner of oaths, such as a notary public or a solicitor, who is required to witness the authenticity of the deponent’s signature.
Any person having the intellectual capacity to take an oath or make an affirmation and who has knowledge of the facts that are in dispute may make an affidavit. There is no standard form or language to be used in an affidavit. When filing an affidavit the deponent must clearly write down the account of the facts as they actually happened using plain English.
The deponent is responsible for the truth and accuracy of the contents of the affidavit, knowingly making a false affidavit is contempt of court.
Affidavits can be used in various circumstances, they are generally used in business and in judicial and administrative proceedings.
